Mark Seiberling, Samantha Zimmer, Jonathan Rava, and Patrick Feeney continue to represent Philadelphia Montessori Charter in a dispute with the Philadelphia School District (The District). The dispute alleges that The District violated state law and the school’s constitutional rights when undertaking the charter renewal process. The team argues that The District’s “shifting standards and inconsistent methodologies and procedures” do not provide a fair or neutral renewal process for charter schools. Recently, Philadelphia Common Pleas Court Judge Damaris Garcia ordered that the school board is temporarily enjoined from moving forward with nonrenewal proceedings against Philadelphia Montessori Charter. The decision is important, not just for Philadelphia Montessori Charter, but for other charter schools impacted by The District’s wavering and inconsistently-applied nonrenewal procedures. A hearing to further review the suit has been set for July.
