Kleinbard’s Litigation team, lead by Mark Seiberling, Joshua Voss, and Francis Notarianni prevailed in the Pennsylvania Supreme Court and revived the firm’s effort to recoup its legal fees from the Lancaster County District Attorney’s Office. Earlier this year, Francis Notarianni argued the case before the High Court. This week, in a 6-1 majority opinion issued on December 18, 2024, the Pennsylvania Supreme Court held the trial court prematurely determined that the district attorney lacked the authority to contract Kleinbard for work exceeding his office’s legal budget because Kleinbard adequately pleaded that the district attorney had access to non-budgeted funds that were generated from fees collected from programs run by the district attorney’s office. The majority and concurring opinions explained that the non-budgeted funds appear to fall outside the existing statutory framework and encouraged the General Assembly to review how district attorneys’ offices use non-budget funds.
