Litigation Partner Joshua Voss was quoted in Law 360 on contention arising from a special master judge’s plan to determine how much money states that challenged Delaware over MoneyGram checks will receive and when. Recently, the Supreme Court ruled in favor of Pennsylvania and several other states that challenged Delaware’s possession of $300 million in abandoned MoneyGram checks. Judge Level discussed a plan to resolve remaining disputes in the matter, which led to representatives from Pennsylvania, Arkansas, and Delaware putting forth claims about what is owed. A representative from Delaware raised concerns that MoneyGram’s records may not be accurate and wishes to request a mediator to evaluate the records. Voss said that “according to the laws of escheatment, as well as those of Pennsylvania, we rely on the holder’s books and records. The holder’s books and records have been supplied to us. There is nothing to mediate.”
