Managing Partner Matt Haverstick was quoted in The Philadelphia Inquirer on The Delaware River Basin Commission’s approval of a permanent ban on hydraulic fracking. The decision affirms a drilling moratorium imposed in 2010 by the commission and comes just one month after a federal judge set an October trial date to hear challenges from landowners regarding the moratorium. Additionally, Pennsylvania Republican lawmakers and the Demascus Township filed a septate complaint alleging that the moratorium illegally usurps state legislators’ authority to govern natural resources.
Haverstick, who filed the suit on behalf of the Republican caucus, noted that the commission’s decision does not alter the underlying argument in the lawsuit.
“It’s still a taking that was never authorized by Pennsylvania under the compact,” said Haverstick. “So the core issues from my standpoint remain.”
