Jennifer Zegel, a partner in the Firm’s Trusts and Estates Practice, co-authored part three of a six-part article series on post-mortem privacy with Lee Poskanzer, and Sharon Hartung. In this edition, the authors discuss pre-planning options using online tools to ensure digital assets and accounts are preserved, distributed, or deleted per the users’ wishes. The article also explains the impact of The Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA) which governs access to a person’s online accounts when the account owner dies or becomes incapacitated.
