Justin S. Brooks



Justin is a litigator with nearly 20 years of experience in all aspects of complex business litigation. His practice areas include qui tam suits under state and federal False Claims Acts, corporate governance and partnership disputes, real estate and construction litigation, class action defense, contract and business tort claims, trade secret misappropriation, and employment litigation. He represents both plaintiffs and defendants in trials, arbitrations, and appeals.

Justin also provides employment and compliance counseling to companies and represents institutional investors in shareholder derivative and corporate governance litigation. He has represented clients in claims brought under the Federal False Claims Act, securities laws, the Worker Adjustment and Retraining Notification Act (WARN), Racketeer Influenced and Corrupt Organizations Act (RICO), and various employment discrimination, labor and environmental statutes.

In addition to litigation services, Justin provides fractional general counsel services, including contract review, legal support for human resources, review of policies for compliance with state and federal laws, website compliance review, and litigation triage. He enjoys working with founders, operators, startups, and high growth companies.

Prior to joining Kleinbard, Justin founded his own law firm and practiced at two preeminent international defense firms – where he focused on all aspects of complex litigation and employment litigation and two prominent plaintiffs’ boutiques where he focused primarily on qui tam litigation, corporate governance litigation, employment litigation and complex commercial litigation. His extensive experience representing both plaintiffs and defendants provides him with significant insight into how both sides work, benefiting clients, whether large or small businesses, institutional investors, individuals, or classes of plaintiffs. He also served as a law clerk to the Honorable Suzanne B. Conlon of the U.S. District Court for the Northern District of Illinois. Prior to graduating from law school, he served as an intern to Judge John. E. Sprizzo of the U.S. District Court for the Southern District of New York and the Honorable Arlen Specter of the U.S. Senate.

Justin authored numerous articles on the False Claims Act, class action litigation and other topics. Publications include: “The False Claims Act Litigation Checklist” and “False Claims Act Litigation: Representing the Plaintiffs” (published by and available through LexisNexis); “Corporate Compliance Programs: Pretext or Panacea,” Emory Corp Governance Accountability Review; “The Ascertain ability Fallacy and its Consequences,” AAJ Class Action Newsletter (2015); and “Navigating Developing Challenges in Approval of Class and Collective Action Settlements,” which was featured in the American Bar Association’s Journal of Labor and Employment Law. He has also contracted with Lexis Nexis to draft a False Claims Act treatise with anticipated completion in 2026.
