This CLE will guide attorneys through the Right-to-Know Law from the perspective of how it applies to records of private, third parties. It will demonstrate the basic process of the RTKL, how the RTKL implicates third party records, the appeals process for third parties, areas of concern for third parties, and provide tips and suggestions for third parties who wish to keep their private records private when dealing with public agencies.

Mark Seiberling is a partner in Kleinbard LLC’s Litigation Department. He currently practices primarily in the areas of complex commercial litigation, appellate litigation, Right-to-Know Law, education, and white collar criminal defense and internal corporate investigations. Joshua Voss (Kline School of Law ’09), an associate in Kleinbard’s Litigation Department, focuses his practice on commercial litigation, appellate practice, the Right-to-Know Law, and litigation by and against public officials and agencies.

Both Seiberling and Voss have been involved in all aspects of RTKL litigation, including representing agencies, requesters, and interested third-parties. Seiberling and Voss litigated the case of Levy v. Senate all the way to the Pennsylvania Supreme Court.
