On June 30, 2016, Kleinbard, representing Pennsylvania Manufacturers’ Association Insurance Company, continued a string of successes in PMA’s ongoing insurance coverage dispute with Penn State arising from child sexual abuse by Penn State’s former assistant football coach, Gerald Sandusky. Judge Gary Glazer of the Philadelphia Court of Common Pleas denied Penn State’s motion seeking immediate appeal of Judge Glazer’s May 4 Order granting partial summary judgment to PMA and holding that some of Penn State’s claims were barred by an abuse or molestation exclusion in PMA’s policies for certain years.  Judge Glazer’s June 30 Opinion adopted much of the reasoning and language of Kleinbard’s brief on behalf of PMA opposing Penn State’s motion.
