Shohin Vance, an associate in Kleinbard’s Litigation Practice and a member of the Disciplinary Board of the Supreme Court of Pennsylvania, presented at The National Council of Lawyer Disciplinary Boards’ 20th Annual Conference. Shohin’s presentation, “Collateral Estoppel and The Disciplinary Process” focused on whether a court decision in a prior non-disciplinary action applies to subsequent disciplinary proceedings. The presentation addressed whether an attorney’s participation in a prior non-disciplinary action as counsel for a party in a previous action be considered a “full and fair” opportunity to litigate the issue in question for purposes of the latter disciplinary proceeding where the attorney in the prior action is now the respondent in a subsequent disciplinary proceeding, and how the disciplinary process and sanctions should be carried out on these occasions.
