Steve Engelmyer and Paul Gagne Present on Insurance Coverage and Abuse Claims

Kleinbard insurance litigators Steve Engelmyer and Paul Gagne presented a seminar at the American Camp Association’s Keystone Retreat on November 9th at the Bear Creek Mountain Resort and Conference Center in Macungie, PA.  Engelmyer and Gagne’s session is entitled – Understanding the Implications of Abuse Claims.  The session covered ways to monitor for and prevent child abuse, the importance of having appropriate insurance coverage, how to investigate claims of abuse and how to report and assert a claim for insurance coverage.

Engelmyer is Chair of Kleinbard’s Litigation Department.  He has over 30 years of experience in all facets of commercial litigation with particular emphasis on insurance coverage, contract disputes, telecommunications, employment disputes, and environmental issues. He represents clients in a broad range of commercial disputes and acts as chief litigation counsel to numerous private and publicly-held companies.

Gagne is Of Counsel to the Firm and is a member of the Litigation Department.  He practices in the areas of commercial, tort, insurance coverage, and intellectual property litigation in state and federal courts.  He has extensive experience in complex commercial litigation, including business disputes, business torts, intellectual property disputes, contract disputes, employment disputes (including restrictive covenants), insurance coverage matters, and insurance bad faith litigation in the state and federal courts.

Kleinbard’s insurance litigation team is currently representing Pennsylvania Manufacturers’ Association Insurance Company  (PMA) in a recently settled complex and protracted litigation involving claims by Penn State arising from the sexual abuse by its former Assistant Coach, Jerry Sandusky. Kleinbard’s attorneys have achieved significant victories in this case including when Judge Glazer issued a ruling on three summary judgment motions that resolved several critical issues in PMA’s favor in advance of this matter proceeding to trial.  In particular, the court held that Penn State is not entitled to any insurance coverage under seven PMA policies in effect from 1992 through 1999 because these policies contained an enforceable exclusion that excluded coverage for the sexual abuse claims against Penn State.
